(“Site”) and/or purchasing something from us, you agree to be bound by the following Terms and Conditions (“Agreement”), including any additional terms and conditions and policies referenced herein and/or available by hyperlink. This Agreement applies to all users of the Site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content. Please read this Agreement carefully before accessing or using our Site. By accessing or using any part of the Site, you agree to be bound by the terms of this Agreement.

Products and Services

Our online store is hosted by Bigcommerce.com (“Online Store”). It provides us with the online e-commerce platform that allows us to sell our products and services to you.

By using this Site, you represent that you are at least the age of majority in your state. To purchase products, you must be at least twenty-one years old.

American Bulldog Arms, Inc. does not represent or warrant that its products and services, including, but not limited to, firearms, ammunition and magazines, are legal to own, possess or use in your jurisdiction. You are responsible for determining the legality of any products or services pursuant to the laws applicable in your jurisdiction before placing an order. Attaching certain accessories to your firearm may render it prohibited in certain jurisdictions. Prior to installation, verify that your state and local laws allow you to install the specific accessory on your firearm.

We reserve the right to discontinue any product at any time. Any offer for any product or service made on this Site is void where prohibited.

We reserve the right to refuse any order you place with us. We reserve the right to limit the quantities of any products or services that we offer. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

Pricing and Specifications

Prices and specifications for any products or services sold through the Site are subject to change at any time without notice, at our sole discretion. Typographic, photographic, and/or descriptive errors are subject to correction. We reserve the right to limit product quantities.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Site will be corrected.

We have made every effort to display as accurately as possible the colors and images of our products shown on our Online Store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

Accuracy of Billing and Account Information

You agree to provide current, complete and accurate purchase and account information for all purchases made at our Online Store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

 

Eligibility to Purchase Products

By purchasing products from American Bulldog Arms, Inc. either in person, online, or by telephone, you represent that you:

1. are a U.S. citizen or a legal alien lawfully admitted for permanent residence in the U.S.;
2. are not under indictment for, and have not been convicted in any court of, a crime punishable by imprisonment for a term exceeding one year;
3. are not a fugitive from justice;
4. are not an unlawful user of or addicted to any controlled substance;
5. have not been adjudicated as a mental defective and have not been committed to any mental institution;
6. have not been discharged from the Armed Forces under dishonorable conditions;
7. have not renounced your citizenship (if you were ever a citizen of the United States);
8. are not subject to a court order that restrains you from harassing, stalking, or threatening an intimate partner or child of such intimate partner, or engaging in other conduct that would place an intimate partner in reasonable fear of bodily injury to the partner or child;
9. and have not been convicted in any court of a misdemeanor crime of domestic violence.

You will be required to either provide a copy of your federal firearms license (“FFL”) or sign a form under penalty of perjury attesting to the above requirements and provide a photocopy of government issued identification showing that you are at least twenty-one years old and listing your physical address (such as a driver’s license, concealed carry permit, etc.) before your first order is processed (“Eligibility Form”).

The FFL or Eligibility Form can be sent to American Bulldog Arms, Inc. by mail, email or facsimile.

American Bulldog Arms, Inc. will maintain your FFL or Eligibility Form on file and will ship additional orders to the address on file without the need to submit an additional FFL or Eligibility Form for each subsequent order.

By placing additional orders, you represent that your FFL remains valid and/or that all information on the Eligibility Form remains true and correct. It is your obligation to ensure that the FFL you have on file remains valid and to provide a updated version if it expires and is renewed.

Return Policy

All sales of firearms (including lower receivers) and ammunition sales are final.

General Shipping Policies

We ship items out as soon as possible, but this will not always be the same day as your order. In general, please add 2-3 business days to allow for processing time.

Products are shipped only to physical addresses in the United States.

All shipments will require an adult signature on delivery.

Shipping Restrictions for Firearms & Lower Receivers

All firearms, including lower receivers, can only be shipped to the holder of a federal firearms license (“FFL”).

If you do not have an FFL, you will need to make arrangements with an FFL dealer in your state of residence who will agree to receive the firearm from American Bulldog Arms, Inc. on your behalf and then transfer it to you in accordance with all requirements of federal, state and local law.

To purchase a firearm, please include a copy of your FFL, or the FFL of the dealer in your state of residence who has agreed to receive the firearm from American Bulldog Arms, Inc. on your behalf.

If you have any questions about whether you are eligible to receive a firearm, you should raise them with your attorney or FFL dealer before ordering a firearm from American Bulldog Arms, Inc.

By ordering a firearm from American Bulldog Arms, Inc., you are representing that you are eligible to receive a firearm pursuant to all applicable federal, state and local laws. If your FFL dealer is unable to transfer the firearm to you because you are not legally eligible to receive it for any reason, American Bulldog Arms, Inc. will not issue a refund.

You are responsible for arranging with your FFL to timely pick up the firearm and to pay any transfer fees it charges.

All firearms require an adult signature on delivery to your FFL dealer and will be sent by either FedEx Priority Overnight, UPS Next Day Air Service, or U.S. Priority Mail.

Shipping Restrictions for Magazines

1. By placing an order for magazines, you represent that it is legal for you to own the magazine pursuant to your state and local laws.
2. Magazines are shipped only to the address listed on your FFL or the government issued identification you provided to establish that you are at least twenty-one years old.
3. Magazines are shipped only to physical addresses in the United States.
4. Due to restrictions in state and local laws, it is the policy of American Bulldog Arms, Inc. not to ship magazines to California, Colorado, Connecticut, District of Columbia, Hawaii, Illinois, Massachusetts, Maryland, New Jersey, or New York.
5. Any magazine orders with a shipping address to one of the above states will be canceled.

Shipping Restrictions for Ammunition

1. By placing an order for ammunition, you represent that it is legal for you to own the ammunition pursuant to your state and local laws.
2. Ammunition is shipped only to the address listed on your FFL or the government issued identification you provided to establish that you are at least twenty-one years old.
3. Ammunition is shipped only to physical addresses in the United States.
4. Due to restrictions in state and local laws, it is the policy of American Bulldog Arms, Inc. not to ship ammunition to California, Connecticut, District of Columbia, Illinois, Massachusetts, New Jersey, or New York.
5. Any ammunition orders with a shipping address to one of the above states will be canceled.

Lead Warning

By purchasing ammunition or ammunition components, including, but not limited to bullets and primers from American Bulldog Arms, Inc., you acknowledge that you are aware that handling, discharging, and reloading ammunition, and discharging and cleaning firearms may cause exposure to lead, and agree to hold American Bulldog Arms, Inc. harmless and assume full responsibility for any such exposure.

Errors, Inaccuracies, Omissions and Modifications

Occasionally there may be information on our Site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Site or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Site or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Site or on any related website, should be taken to indicate that all information in the Site or on any related website has been modified or updated.

We are not responsible if information made available on this Site is not accurate, complete or current. Indemnification

In the event American Bulldog Arms, Inc. is required to incur costs or expenses, including attorneys’ fees, in connection with enforcing or defending its rights under this Agreement, you agree to reimburse American Bulldog Arms, Inc. for any such costs and expenses, including attorneys’ fees.

You also agree to defend, indemnify and hold harmless American Bulldog Arms, Inc. and its directors, officers, employees, parents, subsidiaries, affiliates, agents, contractors, suppliers, service providers, licensors, partners, and/or subcontractors harmless from and against any and all claims, demands, losses, damages, costs and expenses, including attorneys’ fees, made by any third-party due to, arising from, or in any way related to, your use of this Site, breach of this Agreement or the documents it incorporates by reference, your violation of any law or the rights of a third-party, or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

American Bulldog Arms, Inc. reserves the right, at any time and for any reason in our sole discretion, to change, modify, amend, replace and/or update the terms of this Agreement. Whenever a change is made the new Agreement will be posted on the Site, and will specify its effective date. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Site following the posting of any changes to the Agreement constitutes acceptance of those changes.

Termination

This Agreement is effective unless and until terminated by either you or us. You may terminate this Agreement at any time by notifying us that you no longer wish to use our Site, or when you cease using our Site.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes, including, but not limited to, provisions governing the resolution of any disputes.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of this Agreement, we also may terminate this Agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination.

Severability

In the event that any provision of this Agreement is determined to be unlawful, void or unenforceable, the unenforceable provision shall be deemed to be severed from this Agreement, and such determination shall not affect the validity and enforceability of the remaining provisions.

Notice

American Bulldog Arms, Inc. may deliver notice to you by means of e-mail, a general notice on this Site, or by other reliable method to the address you have provided to American Bulldog Arms, Inc. through this Site or when placing an order.

Miscellaneous

The headings used in this Agreement are included for convenience only and will not limit or otherwise affect the Terms and Conditions.

Any ambiguities in the interpretation of this Agreement shall not be construed against the drafting party.

American Bulldog Arms, Inc.’s failure to insist upon, exercise, or enforce strict performance of any right or provision of this Agreement shall not be construed as a waiver of any provision or right.

Neither the course of conduct between the parties nor trade practice shall act to modify the terms of this Agreement.

American Bulldog Arms, Inc. may assign its rights and duties under this Agreement to any party at any time without notice to you.

Entire Agreement

This Agreement and any policies or operating rules posted by us on this Site constitutes the entire agreement and understanding between you and us and governs your use of the Site, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the this Agreement).
